This portal has been designed and managed by the Mexico City Digital Agency for Public Innovation, hereinafter “The Agency”, in its capacity as the party responsible for policies related to data management, open government, digital government, technological governance, connectivity governance, and infrastructure management for the Mexico City Government. Likewise, the portal has been designed to integrate useful information where representatives of state governments and / or agencies may consult those developments made by “The Agency” and express interest in sharing them or adopting them for their own agencies.  Any person wishing to make use of the services offered by this portal may do so subject to these “Terms and Conditions of Use” as well as the policies and principles described in this document.

• OBJECT

This document describes the general terms and conditions for use of the portal, hereinafter “NEGO”, which allows access to information about the technological developments made by “The Agency” and to establish contact with those in charge of such developments, in order to facilitate their sharing with other agencies and governments. 

•  ACCEPTANCE OF TERMS

Entry to and use of the portal “NEGO” implies that you have read, understood and accepted the present “Terms and Conditions of Use”.  This portal will require the express authorization of users to access functions from a computer or cell phone to provide attention and to follow-up to requests for information made through the form available on the site nego.cdmx.gob.mx.

•  RESPONSIBILITY FOR THE USE OF THE “NEGO” PORTAL

You assume responsibility for all the actions you undertake, in the use and consultation of the “NEGO” portal, and it is considered that you do so voluntarily. You will not use, nor allow other users to use the portal, nor any service provided through it, contrary to the provisions of these “Terms and Conditions of Use”, as well as the legal provisions applicable to the services offered by the “NEGO” Portal. This portal shall only be used for informative purposes and for requesting additional information on technological developments of “The Agency”. You acknowledge and agree that the Mexico City Government is released from all liability for the misuse of any part of the “NEGO” portal. As with any technological development, the “NEGO” portal is fallible and will be in a permanent process of improvement; therefore, there is a possibility, although remote, that technical failures may occur during its use; therefore, the Mexico City Government does not guarantee that said portal is free of errors; for this reason, you release the Mexico City Government from all liability, responding from any and all damages and losses arising from the circumstances set forth in this paragraph. The Mexico City Government will not assume any responsibility for the inconveniences that you may experience with the computer equipment and accessories -hardware and software- used to connect to this portal; likewise, it will not assume any responsibility for procedures that have been left unfinished, for reasons beyond the control of “The Agency”. In no case shall the Government of Mexico City be liable for the consequences of improper or fraudulent use of the “NEGO” portal, whatever the cause of the eventual damage.

• SERVICE CHANGES AND UPDATES

The Mexico City Government, through “The Agency”, has the full right to make modifications to the contents offered, whether temporary or permanent, at any time; therefore, it is not possible to guarantee the availability or the continuity of the operation of the “NEGO” portal at all times or during the time of updating. The Government of Mexico City assumes no responsibility for any failure that may occur with the use of this application, whether due to changes and updates, or from any other cause. The Mexico City Government reserves the right to modify, restrict or delete all or any of the attributes of the “NEGO” portal, temporarily or permanently, without these measures being subject to any requirement or right to claim damages on the part of any user.

• PRIVACY AND PERSONAL DATA PROTECTION POLICIES 

The processing of personal data will be limited to the fulfillment of the purposes established in the privacy notice of this platform and will be carried out in accordance with the provisions of the Law for the Protection of Personal Data in the Possession of Obligated Subjects of Mexico City and the General Guidelines for the Protection of Personal Data in Possession of Obligated Subjects of Mexico City.

• INTELLECTUAL PROPERTY POLICY

The “NEGO” website is a work protected by Mexican and international laws and treaties on intellectual property. The use of the “NEGO” portal does not make you the owner of any of the intellectual property rights of the same, nor of the content or information which you access. It is forbidden to use the name, brand, or logo, as well as that of the Mexico City Government. Likewise, you may not remove, hide, or alter the legal notices displayed therein. Notwithstanding the foregoing, you may print, copy, or store them, as long as it is for strictly personal use.

•  DISPUTES AND APPLICABLE JURISDICTION

“The Agency” reserves the right to file civil or criminal actions when improper use of the information contained in the “NEGO” portal is detected, or for the breach of the present “TERMS AND CONDITIONS OF USE”. The relationship between “The Agency” and “USERS” shall be governed by the legislation in force in Mexico City, and that which is applicable at the federal level. In the event of any legal controversy, the parties shall submit to the jurisdiction of the courts of Mexico City, according to the corresponding subject matter.

The entry and use of the “NEGO” portal implies that you have read and accepted the present “TERMS AND CONDITIONS OF USE”.
